I had this page open in my browser last night.....turned the pc on this morning and there were 2 new posts, while it's sat in the pit for so long with no reactions.
I've sent you my bit......I'd like some clarity about the "cancelling accounts" especially on routenote, cancelling through you Denis is no problem but does routenote also cancel and delete the song and info etc ? They do say that they 'own' everything on the site.
If you enter a song into a battle at bandAmp you cant delete it (because it goes into another folder).
And if someone cancels a song entry what does that mean to the album? It's line up.
If it's released as an album there should be no "cancelling account" at all if you ask me .
It's an Album...it's released as it is, like a bandAmp battle once your in your in klaar!

I'll have to check whether or not if one particular song can be removed from the album, I know for sure you can remove the album and indeed delete your account at anytime.
I'm happy to commit to the album for life, hence I can still create another album with the same song - this is acceptable with routenote.com - So if everyone else feels the same, then Let's do it.
If we do this then we need to amend the agreement for the administration, in years to come when my brain and physical limbs give up the ghost...., the administration should be handed back to bandAMP.com/or other

From my side we can start it up . It´s just one song . I can´t see any danger to be plagiated or abused by someone out there . Think we won´t get rich and famous with it . We´re just amateurs with fun in music and sharing it with people who like it . Not more , not less. Also I´m not interrested in financial aspects with this project . If it will bring a handvoll bucks , OK , nice . But it´s not my goal .
More important for me is to be part of the project and this community . So I don´t think too much about abusing my / our music .

I'll give this thread another week before finalising the agreement. - Then I will email the agreement to everyone, once I've received confirmation from all members that are on the album, the album will be uploaded on routenote to be published.
Once we are set-up, future albums will be easier to publish - One per annum I think. I'm hoping one day the Battles will be fully functional, the one thing that deters ampers entering the battle is the amount of votes required to qualify, currently 15. This should be eliminated completely. I think that it should be set-up so that any new song that is uploaded automatically goes into the battle. The winner of of the battle gets to be included in the next album. Since our main aim here on bandAMP is to improve, competition is a great way to motivate us. So let the Battle commence.

Good call on the battle incentive..... it has been mentioned before ..... "but now that dream is slowly coming true".... yes get rid of the "compulsory 15" and just have "highest amount of votes", keep voting open all year so all songs always have a chance, more like 'charts' than battles !
We'll have to ask god if it's possible !

Well from kings suggestions I agree that we should all commit to the album for life, also I think that if you are not happy with the way I administrate it, the moderators of bandamp.com have the power to pick another member by means of a members vote.

ULI's sentiment, reasoning and attitude is fine, but may not represent the sentiment, reasoning and attitude of everyone involved. It is misleading to imply that the site will take over the management of this project if someone takes issue. People need to understand that they are essentially surrendering that level of control, and there is no guarantee, (implied or otherwise) that they may be compensated or protected to their liking. This needs to be clearly stated in the agreement.

I would suggest that everone puts a signed copy of the agreement in their bandAMP photo album. I just thought I think there is a tab somewhere on the site where you can upload it too and, or, it can even be put in this thread

What if I die, what will happen then, what if the majority of members don't like the way it's being administrated.
This is not an agreement by me it's a bandAMP members agreement. I will be setting up a bandAMP account with routenote.com which will be called bandAMP Productions. I am purly administrating it only, not to mention adding one of my songs.

Again, the members need to understand that if you die, or if they don't like the way it's being administered, that they are surrendering those elements of control over their contributions. There is no protection afforded by Bandamp, the site. You simply need to remove those statements from the agreement. Denis initiated this project and is to be admired for taking on this effort; however, his mistake was presuming that administration (or any other responsibility) should at any point in time become the responsibility of Bandamp.com. This project involves potential property issues, and there are liabilities that come along with this. Up until this point, Denis has been pursuing this project on his own steam and his own dime to this point and has (perhaps unwittingly) contributed to a perception that this is his project (which implies that he will be the point man) in the event any problems arise. Naturally, this would be a risky endeavor on his part, but that is his option. There are 18 participants involved. They are contributing property with some (at least implied) expectation of remuneration. In fact, they have absolutely no guarantee of protection or remuneration. That may be fine if you adopt the philosophy of ULI or Kings, but again, we cant assume all 18 members share these feelings or will maintain those attitudes later. Hopefully, each participant is making his/her offerings with knowledge that he/she assumes all risks inherent in this arrangement. The site needs to be very clear in its communications with regards to this fact up front.
The controversy that can arise out of this can be potentially complicated and damaging for the community, particularly if there are misconceptions that are (perhaps unintentionally) allowed.
Additionally, Bandamp is still owned by Mudd. All the rest of us are simply volunteers who have the option to disappear at any point in time (as weve seen demonstrated repeatedly in the past) and anyone who may agree to assume responsibility for the outcome of this project now, may not be here tomorrow. Mudd didnt agree to hold responsibility for this project.
Thus, to be fair, honest and forthcoming, each participant needs to understand that Bandamp,com cannot be responsible in any way for any problems that may arise out of this project and the agreement needs to state this clearly. Each participant needs to indicate by signature that they understand their risk and are willing to take it. If they are not willing to take the risk then they need to reconsider their participation in the project.

As is often the case with recording projects contracts there are many hidden issues that can (and will) pop up. One of the most important things about doing business in the music world is to understand what can happen and how to make it happen or prevent it from happening. This is why contract law is so important as a musician.
Some of the common pitfalls come from the fact that musicians love what they do (hopefully) and want others to experience their music. Maybe this is ego-centric but there is a very delicate balance between the ego and shedding one's ego to create the music or art. Drummer Tony Williams wrote about this on his liner notes for his album "Ego".
I have been screwed several times because I was willing to take the risk. However in most cases I have been fortunate enough to find honest people.
As far as offering to pay the artists "in purpetuity" this is difficult since both the artists and publisher cannot foresee the state of anything in the future. The way one feels about the project now may be very different than in twenty years. My guess is that in twenty years, if the compilation is not making a ton of money, Denis will be burnt down to a cinder trying to deal with record-keeping and payments every six months even if this is a great project full of life now. Life has a way of doing this.
My suggestion in general is to limit the length of the project somehow to three years with the possibility of renewal in which all licensing is purchased and the only money the artists get is the licensing fees for the compilation (plus royalties from broadcasts, etc. as an author). Although this costs money there is less risk of getting caught in a big mess.
Usuallly, when I have a contract for a contribution to a compilation it is limited temporally, spells out exactly how much is paid per unit, how and when it will be paid, and the contract is several pages long. The length is due to the specifics such as defining language; what artist, producer, unit, and so on means as well as who owns what.
It gets complicated but is a necessary evil since there are so many non-altruistic blood-sucking thieves in the music biz.
I definitely understand Battlecat and see how this cannot be do with an affiliation to BandAMP. That would have to be something that BandAMP can only do. Just as we can't set up our own compilation using any other label - only they can do that.

Thank you kings, this is exactly why I put this in the agreement.
I did this project for the LOVE of doing it and the community and friendship I have. It's something that we can pass onto our family and generations to come, so at least in our families eyes they can look back and find a quality musician.
I'm sorry for pulling out, there is one thing I can't handle is POLITICS and ADMIN

Here is a breakdown, Note I had an album on this site and withdrew it, the $1.05 is from my own album, all the other sales are form bandAMP Vol 1 - It's one of the reasons why I withdrew it only to show bandamp sales, hence I've transferred my albums to routenote.com as it is free.
I've also cancelled the agreement on bandAMP I which comes up for renewal soon, I don't want to pay the renewal fee, so will transfer it onto routenote.com where it is free, wghen I do I'll set-up a bandAMP production account to keep the transactions separate.

Just wanted to second all that Kings said. This has become a complicated thread and I guess it should be. Everyone has had a valid point in this and as a musician I guess I just concentrate on the love of the music and I sometimes forget that there are leagal issues and technicalities that surround a project like this.
I don't think anyone expects to be famous from this or at least I'd hope not. For me it's not about money or fame or ego, it's about the song writing, the personal pleasure I get from working on them, and the exposure to and feedback from the members here at BandAmp.
I am honored to be on the list but if it came down to limited space on the server then I'd be the first to volunteer to give up my song in favor of the other excellent tracks on this album....SA
I don't think anyone expects to be famous from this or at least I'd hope not. For me it's not about money or fame or ego, it's about the song writing, the personal pleasure I get from working on them, and the exposure to and feedback from the members here at BandAmp.
I am honored to be on the list but if it came down to limited space on the server then I'd be the first to volunteer to give up my song in favor of the other excellent tracks on this album....SA

Though I do think Denis is just trying to cover one of those corners a lot of people dwell on these days ... the continuation of their online 'presence' as time inevitably goes by.
He is just trying to say "I'm looking after it now but if something happens to me bandamp.com can choose a new administrator for this project" .... and there's nothing wrong with that.

Re uploaded the pic. To answer your question, all the downloads are single tracks, hence you have a choice, if you order the album it works out cheaper, also the price varies between each seller, iTunes is generally more expensive, it's amazing how they get away with it.
Iszil, the only way we can sell more is by marketing, gigging, promoting, advertising....... Then it's up to the public if they like it or not.

Oh, no! You know, I never related this with what I intend to do when I make my own album... until you just mentioned.
However I'm not really sure how I will promote it. I have no clue what to do so I'll just upload it in some sites like you do and see how it goes. Plus giving a few copies to my former teachers from when I studied music. Also showing it in other music communities I participate.
That's all I have in mind.

I don't understand this discussion and (sorry) I did not read the entire thread. Denis is doing a great work and has shown big efforts in this project. Thank you Denis so far. Until today I didn't sign the agreement but that's not the problem of Bandamp. I simply forgot to do that. It's still a fantastic idea to promote a Bandamp album. But all of us can't expect to become rich one day by publishing this album. And if someone really is interested in my track and pays for that, so why not. Do I need THIS money what is nice to have? Maybe I would spend for some prizes to win in the battles (if they would work properly one day). Bandamp is a non-commercial site! We all are amateurs and home recorders except a handful of members who have the ability to do more with their musical skills.
For me it's a matter of community, of family, of social cohesion. This gets lost in my eyes.

When this project was started I was relatively "fresh" on this forum and I felt honered to be elected into the project . Thought it would become a thing of idealism , fun , friendship ( if possible via net) and the enthusiasm to be part of a common spirit . Now I know : blueeyed
As everywhere in life it is difficult to reduce sth. to a common denominator.
That´s my point now . this common spirit is lost now in my personal sence .
I´d like to hear a clear word if there´s any intention of everybody to continue or carrying to its grave ??

Battlecat is not happy with the agreement, I've sent him a pm today with some information that may help the situation.
We all need to be happy with the agreement, It's difficult to please everyone.
It may be an idea if you communicate with battlecat and hopefully come to some compromise.
My question is who is the boss of bandAMP, it is my understanding that mudd passed the site onto it's members. If Mudd is still the Boss, then we should perhaps put the matter to him. If we the members are in control, then we need an official committee as you suggested, it could be You, Battlecat and kings??

Dont worry about bandAmp.....if anything, things like this make us stronger .... see how it goes, Denis makes a thread telling us he wants to make a Vol II, through his efforts and a few suggestions he gets a line up, again through his efforts he gets reactions from the artists in the line up, and then it goes pear shaped !
The usuals will spend a little more time trying to find a solution and a few less usuals may pop in to have their say and we'll eventually come to a conclusion and maybe even a product .... we did for Vol I !
It seems to be the way of the net and trying to organize things through forums .... lots of people and time to consider.
Sorry Denis, but you're still missing the point. I made a simple request, which is being ignored. You didn't consult me or anyone that I know of before you altered the agreement, and now you're upset because I ask you to modify the agreement. I didn't ask you to abort the project, that was your response and only you can take responsibility for that. Stirring up the community and attempting to gang them up against me is not going to help matters. I am not alone in my concerns, but I don't see any evidence that you are considering that. My request still stands. You could end all this if you would simply accomodate my request. Very simple...no need for drama. It is true that you have done a magnificent job of organizing this very large effort to date, and I want to be very clear that I think this is a very good thing - I would be happy with the alteration of the agreement as I stated earlier. Then let the project move on.

Prepare an agreement that you think is suitable and put it to the members if they are all happy with it, inc me then let's do it. you say it's simple, but I'm hopeless at administration, it took me three months just to come up with a basic agreement...lol
I applogise for not asking you about the amendments, but I assure you it was innocence on my part, I assumed that you would not have a problem with this, it was only done in the best interests of keeping the album going for ever, I hope you understand that.
I'm certainly not ganging up on you, as I said to everyone I HATE POLITICS AND ADMINISTRATION
That's why I pulled out immediately, I don't want to cause any problems for nobody.
I've also said that I have no hard feelings with you or anyone for that matter, you have a right to your opions as much as anyone else.
If I'm stirring up the community, then I'll resign from bandAMP. But innocence on Denis' part, in willingness to guarantee continuation of the album's existence into eternity, simply attempted to construct a failsafe device within the community via that disclaimer, also showing himself trustworthy aswell as trusting that we could all stand up for eachother incase of unforeseen troubles. Yet the truly unforeseen breached the pillars under the failsafe construction before it could stand firm, and the whole deal came tumbling down
Anyway, I hope things are settling now, and renewed plans come together soon. I'll wait and see, and no, I'm not in it for the money ofcourse, I'm in it for the spirit of things. Cheers

I do think it would be a good idea to time-limit how long you're going to be responsible for administration of the album, because I feel it is an unrealistic burden to put on you to serve as administrator for this project for longer than that. Several participants who have responded to this thread have indicated they're not particularly interested in profits, anyway. Therefore, I added a line limiting your responsibility to three years (I will remove it if you disagree). Then, I made a couple other changes that I feel will afford better protection for the site. Well, that's exactly the point. Several members have indicated they are only interested in having the experience of participation in the project, (not the profits) and having the album available for the sake of posterity. This project can become a nightmare to take on as a lifelong project and Bandamp should not be implicated in any way. This way, the members can enter into the agreement with full knowledge that they cannot expect lifelong administration (again, select members have so far indicated they don't expect profit). The agreement indicates that they are allowing their work to appear on the album without the option of demanding their removal at any point (hence "on the album for life") which would be impractical, while at the same time indicating they understand they cannot expect you or anyone else to have ongoing responsibility to ensure dispersal of payments beyond three years (if indeed you are willing to commit to that). Dennis I think you need to understand this project has the potential to create management nightmares in the long run, because of the somewhat unrealistic notion that this will be a profit-generating project for a lifetime. Understandably you are concerned about the implications of your responsibility without limit, but this is the situation you created when you devised a project that is supposed to generate profits for 18 people, all contributing potentially valuable properties. Naturally, the potential for complication is present and you, nor any of the participants can reasonably expect that somebody is going to be there to administer the album for perpetuity.

I like the idea to release Vol .2 temporary limited for two reasons .
1 . For the reasons Cat mentioned above
2 . This way every member is enabled to do whatever he wants to do with his album track after this common bandamp project.
I´d like even to suggest to release every project (thisone and any in future ) just for 1 or 2 years . So we can

You're welcome - however, I have thought about your concern and it does make sense that you should have the option to back out, or (on the unlikely possibility) the participants don't like your administration of the project, they should have the opportunity to elect a new administrator - but I think that should be selected from the participants themselves. I think it would be a good thing if you agree to assist with the transition of adminitrative role to a new administrator if that becomes necessary, (and if you're able) But I won't include that in the agreement. I will add another modification for the approval of the participants....(as soon as I get time...I'm at work and pretty busy...)

We may have to change it a little, in that MountStRobbie does not want the particular nominated song on the album, I only found out a few days ago, but having said that we can replace the song, as indeed if any other members decide to opt out, there will be room for more songs, so long as it fits on a CD. You could just change the agreement to say something like 'all partisipants' or' all members/artists', that way we can genrealise the contract for future use. Or just leave it.
Once we are happy with the agreement I'll PM it to all partispating members on the album for the final OK
I've a feeling we may not be able to get hold of some of the members on the album. There are some songs that were nominated and I believe the members are not even aware that their song has been nominated. I'll worry about that when it comes to it, it's not a problem we have thousands of songs and I'm sure many who would want to partisipate.

Once we are happy with the agreement I'll PM it to all partispating members on the album for the final OK
I've a feeling we may not be able to get hold of some of the members on the album. There are some songs that were nominated and I believe the members are not even aware that their song has been nominated. I'll worry about that when it comes to it, it's not a problem we have thousands of songs and I'm sure many who would want to partisipate.

Once the album goes live any artists/participant's song will be on the album for life.

Is indicating full acceptance of responsibility for the outcome of his/her participation in the album project entitled "The AMP Volume Two" and thereby frees Bandamp.com, it's membership, administration, agents, ownership, volunteers including Denis Ahmet of any liability for damages that might occur as a result of the signer's participation in the album project entitled "The Amp Volume Two".
2. Releases BandAmp.com, its membership, agents, volunteers, administration and ownership of any responsibility in administration of the project or the album entitled "The Amp Volume Two".

Forgive my ignorance, I'm not clear how the agreement stands after the three years, should we perhaps have something to state what happens, or is this already convered in the agreement.
(Option One) - Pursue this project three years at a time - make an addition to the current agreement that all participants will have the option to sign a new agreement in two and a half years, in preparation for the end of this current agreement.
(Option Two) - all artists/participants decide now to proactively cease all operations in three years, and the current agreement amended to acknowledge that plan.
Option Two is clean cut. As the album is for life, if after the three years, any artist/participant not wishing to renew the agreement, their portion of monies to be given to bandAMP for maintenance or prizes. Although I believe in order for this to happen a treasurer needs to be appointed.
Or the agreement could just be annual - As it is unlikely the album will make substantial profit due to no marketing etc, I think most members will offer the money to bandAMP

Option two, the way I see it, would mean there would be no more income to manage, as all operations have ceased.
You've got a point about the annual agreement - that might be more practical - however, it does mean you or somebody would have to really stay on top of it and start this whole process (of contacting the participants, presenting an agreement, having them review it and getting their signatures) again in 6 months or 9 months or whatever - just as long as it's done before the existing agreement runs out. That's a lot of maintenence, it seems to me.

Option Two is clean cut. As the album is for life, if after the three years, any artist/participant not wishing to renew the agreement, their portion of monies to be given to bandAMP for maintenance or prizes. Although I believe in order for this to happen a treasurer needs to be appointed.
Or the agreement could just be annual - As it is unlikely the album will make substantial profit due to no marketing etc, I think most members will offer the money to bandAMP
Option two, the way I see it, would mean there would be no more income to manage, as all operations have ceased.
You've got a point about the annual agreement - that might be more practical - however, it does mean you or somebody would have to really stay on top of it and start this whole process (of contacting the participants, presenting an agreement, having them review it and getting their signatures) again in 6 months or 9 months or whatever - just as long as it's done before the existing agreement runs out. That's a lot of maintenence, it seems to me.
We could have a clause saying that unless members give one months written notice to terminate the agreement to expire not less than the end date, the contract becomes a statutory periodic agreement. So that means only one agreement required for album.

Actually my paper is still waiting to be signed by a witness and then to be sanned and mailed to Denis.
